According to Art. 124(3), a person shall be eligible to be appointed a judge of the Supreme Court if he
(1) Be a citizen of India
(2) Has been a judge of any one or more High Courts for at least 5 consecutive years and
(3) Have been an Advocate in any High Court or Courts for 10 consecutive years. or
(4) Should have high degree of knowledge of lawn the view of the President.
In the case of appointment of the Chief Justice of India it has become a tradition over the years that the most senior judge of the Supreme Court will be appointed to this post, but this tradition has also been broken 2 times. Except for 3 senior judges in 1973, Justice A.N. Ray was appointed as the Chief Justice of India. then in 1975 Justice MH Baig was appointed, overtaking Justice HR Khanna.
The President appoints the Supreme Court and other judges of the High Court on the advice of the Chief Justice of India.
